1In consideration of the rental agreement between myself and Kauai Baby Rentals LLC, I acknowledge and agree to the previous Terms and Conditions.
2I understand that there exist certain risks of injury from the use or misuse of the Rental Item(s), including the potential risk of serious injury, disability, death, property damage or loss resulting from the use of such items. Kauai Baby Rentals LLC will not be responsible for accidents or injuries caused directly or indirectly by the use or misuse of the Rental Item(s).
3TO WAIVE ANY AND ALL CLAIMS that I have or may have in the future against Kauai Baby Rentals LLC and their employees, agents, representatives, successors and assigns (all of whom are herein after collectively referred to as the “RELEASEES”) and TO RELEASE THE RELEASEES from any and all liability for any loss, damage, expense or injury including death that I may suffer or that my next of kin may suffer as a result from renting equipment from Kauai Baby Rentals LLC, DUE TO ANY CAUSE WHATSOEVER, INCLUDING NEGLIGENCE, BREACH OF CONTRACT, OR BREACH OF ANY STATUTORY OR OTHER DUTY OF CARE, ON THE PART OF THE RELEASEES, AND INCLUDING BUT NOT LIMITED TO ANY MANUFACTURERS DEFECTS AND OR THE FAILURE OF THE RENTAL ITEM(S) TO FUNCTION AS INTENDED BY THE MANUFACTURER.
4TO HOLD HARMLESS AND INDEMNIFY THE RELEASEES from any and all liability for any property damage or personal injury to any third party resulting from the use of the Rental Item(s).
5That this Agreement shall be effective and binding upon my heirs, next of kin, executors, administrators, assigns and representatives, in the event of my death or incapacity.
6I KNOWINGLY AND FREELY ASSUME ALL SUCH RISKS, BOTH KNOWN AND UNKNOWN, AND ASSUME FULL RESPONSIBILITY FOR MY USE OF THE RENTAL ITEM(S).
7I understand the risks associated with the use of such items and understand the safety concerns regarding the items.
8 I understand that this RELEASE OF LIABILITY covers each and every Rental Item(s) which I have agreed to rent.
9I understand and agree to Pay in Full the Cost of Products/Activities in addition to the Service Charge and Tax for the following services I use including: Convenience Shopping, Concierge Services, Special Events Planning, Check-In Meal Services and Lei / Refreshment Airport Greeting.
10This Agreement and any rights, duties and obligations as between the parties to this Agreement shall be governed by and interpreted solely in accordance with the laws of Hawaii and no other jurisdiction.
